Mandatory DBS checks for governors

The government has published amended legislation which came into force on the 18 March 2016 to make enhanced DBS checks mandatory for governors.

The DfE believes that these checks will provide reassurance to the governing board that an individual is not disqualified from holding office as governor due to criminal convictions.

The School Governance (Constitution) Regulations 2012 have been amended and come into force on 18 March 2016, requiring that:-

  • From 1 April 2016, all maintained school governing boards to apply for an enhanced criminal records certificate for newly appointed (or elected) governors within 21 days of their appointment;

  • From 1 September 2016, all maintained school governing boards to apply for an enhanced criminal records certificate for any serving governor who does not have one.
